The driver in a fatal accident earlier today in Kansas City on SW Trafficway has been charged with causing the death of someone while driving intoxicated, Jackson County Prosecutor Jean Peters Baker announced today.
Malcolm E. Hawkins, dob: 7/29/1991, faces the Class B felony of DWI, Causing a Death with BAC .18 or above, and Operating a Vehicle Without a Valid License.*
According to court records, police responded to 37th and SW Trafficway about 3 a.m. today on a fatal vehicular accident. A witness told police he saw the vehicle speeding up Southwest Trafficway when it hit the median and spun out of control. The vehicle struck a building on Southwest Trafficway. Citizens pulled the driver out of the vehicle but a passenger, Diamond M. May, was deceased in the front passenger seat. Police detected a strong odor of alcohol from the driver, who later administered a breath test and found his blood alcohol level at .224.
Prosecutors requested a bond of $100,000.
